Terms and Conditions

Effective 1 October 2026

These terms cover your use of tovstudio.co and explain how estimates, quotes and project work are agreed. Tov Studio is run by Daniel Lun in Johannesburg, South Africa. In these terms “I”, “me” and “Tov Studio” mean Tov Digital (Pty) Ltd, trading as Tov Studio, and Tov Studios LLC for clients billed in US dollars. “You” means anyone using the site, or a client and the business they represent.

Using this website

The site describes my services and past work. I keep it accurate, but it’s general information and I may change or remove anything on it at any time. Please don’t misuse it: don’t try to break or overload it, get around its security or spam protection, scrape it in bulk, or use the contact form to send spam or anything unlawful.

Estimates and quotes

Prices on this site, including the pricing calculator, are estimates to help you plan. They are not quotes or offers, and they don’t create an agreement. A binding price comes only in a written quote or proposal, sent after a scoping call, before any work starts. Prices are shown in US dollars, pounds, euros or South African rand; rand prices apply to businesses registered in South Africa and billed in rand. Any taxes that apply are shown on the quote.

Project work

Each project is agreed in a written proposal that sets out its scope, price, timeline and payment terms. If anything in the proposal differs from these terms, the proposal applies. In general:

  • Work is project-based with a fixed scope, written down and priced before anything is built. There are no subscriptions.
  • Changes to the agreed scope are quoted separately before I do them.
  • Payment is usually 50% to start and 50% at launch. Larger product builds are paid in milestones.
  • A paid discovery sprint, where offered, is credited against the build if you go ahead.
  • Care after launch is optional and bought in blocks of hours, as set out in the proposal.
  • If a project is cancelled, the proposal sets out what’s owed for work already done.

Who owns the work

The final designs and source files I create for you belong to you. Materials you give me (copy, images, logos, data) stay yours, and you confirm you have the right to use them. Third-party products used in a project, such as fonts, platforms, plugins and hosting, are licensed from their owners; where a commercial licence is needed I’ll tell you in writing, and you buy and keep it in your name.

Showing my work

I may show completed work and name the client on this site and in my portfolio, unless we agree otherwise in writing or sign a non-disclosure agreement.

Content on this site

The text, design and code of this site belong to Tov Studio. Client names, logos and the work shown belong to their owners. Please don’t copy or reuse the site’s content for commercial purposes without my written permission.

Links to other websites

Links to other sites are there for convenience. I don’t control those sites and I’m not responsible for their content or how they handle your information.

Liability

The site is provided as it is, and I can’t promise it will always be available or error-free. To the extent the law allows, I’m not liable for any loss that comes from using the site or relying on its content. Liability for project work is set out in the proposal. Nothing in these terms limits any right or liability that the law doesn’t allow to be limited, including under South Africa’s Consumer Protection Act where it applies.

Your information

How I handle personal information is explained in the privacy policy.

Law and disputes

These terms are governed by the laws of South Africa, and the South African courts have jurisdiction, unless a project proposal says otherwise. If something goes wrong, please tell me first; most things can be sorted out by talking.

Changes to these terms

I may update these terms; the effective date at the top shows when they last changed. Changes don’t affect a project already agreed in a proposal.
